Australia has a binding AI compliance deadline arriving in December 2026 and most businesses don't know it exists. Here's what's coming, what's already required, and what a governed approach to AI actually looks like.


Here is a scenario playing out in organisations across Tasmania right now.

A staff member discovers ChatGPT. They start using it to draft client emails, summarise meeting notes, and generate reports. It saves them an hour a day. They tell a colleague. Within a month, half the team is using it. Nobody has asked IT. Nobody has asked management. The data being pasted into a commercial AI system, including client names, financial details, internal strategy documents, and case notes, has left the organisation's control entirely, and nobody knows.

This is not a hypothetical. It is the default outcome when organisations don't have an AI governance framework in place. And in 2026, the absence of that framework carries real and growing consequences.


What Australian Law Already Requires

Australia does not have a standalone AI Act, but that doesn't mean AI is unregulated. AI is governed through a combination of existing technology-neutral laws including the Privacy Act 1988, the Australian Consumer Law, and the Online Safety Act 2021, alongside voluntary frameworks.

The Privacy Act is the most immediately relevant for most businesses. When staff paste client data into ChatGPT, feed customer records into an AI tool, or use AI to make decisions about individuals, existing privacy obligations apply. Many organisations are unknowingly in breach of them right now.

More pressingly: from 10 December 2026, amendments to the Privacy Act introduce new obligations for automated decision-making. Specifically, organisations using AI systems that make or significantly influence decisions affecting individuals in areas like hiring, lending, insurance, and customer analytics will be required to explain those decisions and disclose that AI was involved.

That deadline is eight months away. Most businesses have not started preparing for it.


The Six Practices Australia Expects You to Follow

In October 2025, the Australian Government published its Guidance for AI Adoption, a framework of six essential practices for responsible AI use. While currently voluntary for most businesses, these are widely expected to become the benchmark for "reasonable" AI governance.

The six practices are:

1. Establish AI governance. Define who is accountable for AI use in your organisation, what oversight mechanisms exist, and how decisions about AI adoption are made. In most organisations, nobody currently owns this.

2. Know your AI. Maintain a register of AI systems in use, including vendor tools and individual subscriptions to tools like ChatGPT, Copilot, and similar products. Most organisations have no idea how many AI tools are currently in use across their teams.

3. Manage data responsibly. Ensure data quality, privacy, and appropriate consent across any AI pipeline. This includes understanding where your data goes when it enters an AI system and whether that system uses it to train its models.

4. Be transparent. Disclose when AI is being used in processes that affect others, and how decisions are made. As the December 2026 deadline approaches, this moves from good practice to legal obligation.

5. Ensure human oversight. Maintain meaningful human review of AI-assisted decisions. Automated outputs, whether from a hiring tool, a customer service bot, or an AI-generated report, need a human in the loop for consequential decisions.

6. Operate reliably and safely. Test, monitor, and maintain AI systems appropriately. An AI tool that was appropriate when deployed may behave differently as it is updated. Governance needs to be ongoing, not a one-time exercise.


The Shadow AI Problem

The scenario described at the opening of this article has a name: shadow AI. It is the AI equivalent of shadow IT, the proliferation of tools adopted by staff outside any formal approval or oversight process.

Shadow AI is not a sign that staff are reckless. It is a sign that AI tools are genuinely useful and that the organisation hasn't provided a governed path to adoption. When people find a tool that saves them an hour a day, they use it. They don't wait for a policy.

The problem is what happens to the data.

When a staff member pastes a client's personal information into a commercial AI tool, that data is transmitted to the tool's servers, potentially overseas, potentially retained, potentially used to train the model. Depending on the tool and its terms of service, the data may never be recoverable or deletable. Under the Privacy Act, the organisation that collected that data remains responsible for what happens to it.

This is not theoretical exposure. The Australian government banned the use of DeepSeek on all federal government devices in early 2025 following national security concerns about data handling. The same risk calculus applies to any AI tool where the data handling practices are opaque or the servers are offshore.

Microsoft 365 Copilot, used through an enterprise Microsoft 365 tenant, is a materially different proposition to a free consumer AI tool, because the data governance, the contractual protections, and the compliance controls are explicitly defined. The tool matters less than the governance around it.


What Governing AI Actually Looks Like

An AI governance framework doesn't need to be a lengthy compliance document. For most Tasmanian businesses, it needs to answer five questions clearly:

What AI tools are approved for use? A short, maintained register of approved tools, with the data handling terms understood and documented for each. Staff who know what's approved are less likely to reach for something that isn't.

What data can and can't enter an AI system? A clear policy on data classification: what is permissible to use with external AI tools, and what must stay within governed environments. Most businesses don't think of AI governance as something their IT provider helps with. But it sits squarely in the intersection of IT policy, data security, and compliance, and it requires the same discipline as any other governance framework.
